Thanks Sookietex, for the image. As Pres.-Elect Obama is now to be our President, looks like this image is no longer available on U.S.Senate.gov's website's 'Senators' list', unless I just overlooked it. Anyway, I've given a link to your sight as a 'thank you'. Have a great day. BTW, great blog sight!

Hi Rebecca, thanks. Yeah, the senate.gov site often changes the url of where images were originally posted. we'll keep an eye out for the current one and post the addy when it's available. what with the inaugural festivities and all that may not be for awhile, but we'll be on the look-out.

Anonymous asked: "Does this mean that the the Photo of Pres. Obama is free for commecial use?"

Answer: Yes, that is what it means. Politicians are exempt from laws that would prohibit use of a private citizen's image for purposes of publicity or commercial use.

I want to use the Obama portrait with capitol dome for a t-shirt but was told by the printer it would be a copyright infringement. True?

sookietex said...

hey anonymous, not true, this image was an official portrait of Senator Obama and is a work of the US government from senate.gov.

Generally speaking, works created by U.S. Government employees are not eligible for copyright protection in the United States. See Circular 1 "COPYRIGHT BASICS" PDF from the U.S. Copyright Office.

you may see the Senate's statement about content here U.S. Senate: Privacy Policy:

content moves on government sites as, Mr Obama is no longer a senator but you can see an archived copy of the image page here Internet Archive note the url senate.gov

also politicians are exempt from laws that would prohibit use of a private citizen's image for purposes of publicity or commercial use.

sookietex said...

Hi Chris, there is no need for monetary compensation if you are using the images posted here at Public Domain Clip Art. However, if you would please tell us specifically which images you are going to use we can give a more definitive answer, as it may differ given your intentions. Thanks for stopping by, best of luck with the DVD productions :-)

FYI, Cafe Press has advised its shop owners that the particular Obama photo with arms crossed and capitol in the background (above) cannot be used for commercial purposes, no matter the public domain designation. The photographer, David Capp (sp?) is not willing to allow it and has not been responsive to inquiries. Too bad.

Hi Anonymous, thanks for the Cafe Press FYI. Hadn't heard of that before reading your comment. Gonna do a bit of digging to see if the situation is likely to change.

Sookietex - I lifted this text from another free, public domain photo site, Acclaim Images. It explains the true meaning of "public domain"! "This free, public domain photograph may not be used in materials, advertisements, products,or promotions that in any way suggest approval or endorsement of the President of the United States, the First Family, the White House or any persons appearing in the photos. Stock photography by White House Public Domain.

I have a question. what if I use the photo (obama only, not the background) as a guide for a painting? It is to be used as a commercial venture.
